Consumer protection under Section 5 of the FTC Act. The FTC Act prohibits unfair or deceptive acts or practices, and has established different standards for unfair and for deceptive practices: A representation, omission, or practice is deceptive if it is likely to mislead consumers acting reasonably under the circumstances of a particular case; and it is material in the sense that it is likely to affect consumers’ conduct or decisions with respect to the product or service in issue. The FTC has issued its own Federal Trade Commission Policy Statement on Deception to clarify its standards on this issue. Unfairness was defined by Congress in a 1994 amendment to Section 5 of the FTC Act. Map of Morgan Hill 2016.
