The European Commission is adding the final touches to the RecCraft Directive, which comes into force on 16 June, writes Marian Martin. After that date, a new boat must be CE-marked before it can be placed on the European Economic Area (EEA) market, or put into service there.

However, these additions concern second-hand boats and have implications for anyone considering the purchase of a vessel lying outside the EEA, for the Commission has said that boats which existed prior to 16 June, but were either built or registered outside the area come under the scope of the Directive.

Take two identical Moodys built in 1992; one remained in the UK, the other was shipped to Turkey. Under this ruling, the UK owner can sell his boat into any EU country, without it needing CE marking; the Turkish boat would have to be conformity assessed before it could be imported into the EEA.

This will create a furore in the industry and many believe it flouts international law so, in future, Brussels may be forced to rescind. Anyone who has acquired a vessel outside the EU, and is still in that country’s waters, should check whether they are in the EEA (Jersey, for example, is not).

If they are not and the vessel has never been registered in it, the solution is to make for an EEA port, prior to 16 June, and establish the vessel’s presence there. (A bill for mooring fees should suffice.)
